David is a partner. His practice emphasizes workers' compensation, education law and collective bargaining. He is certified by the Law Society of Upper Canada ("LSUC") as a specialist in Workers' Compensation Law. He is a regular speaker on ­human r­esources and la­bo­ur relations best practices. In 2001, David was the recipient of the OBA's Ron Ellis Award for significant contributions to Workplace Health and Safety Law. In 2006, David was recognized in the Best Lawyers in Canada publication for labour and employment law. This recognition continues into the 2010 edition. David is also recognized as a workplace safety and insurance law specialist in the Canadian Legal Expert Directory.

Recent Decisio­ns

  • Ontario Court of Appeal – Elementary Teachers' Federation of Ontario v. Toronto District School Board, (2006) 203 O.A.C. 123 re pregnancy leave – Human Rights, Employm­ent Standards and Management Rights concerning work assignment following the leave.
  • Arbitration – Elementary Teachers' Federation of Ontario v. Toronto District School Board (Newman, August 27, 2004) regarding the definition of "instructional time" under the Education Act and regulations and whether the Federation's definition under the collective agreement set limits on the work day for teachers. The decision preserved a week of instructional time for students over the course of a school year.
  • Divisional Court, Superior Court of Ontario – Port Weller Dry Docks v. The International Brotherhood of Boilermakers, Iron Shipbuilders, Blacksmiths, Forgers and Helpers, Local Lodge 680 (23 February, 2006) (unreported) regarding upholding last chance agreement provisions cut down by the Arbitrator.
  • Workplace Safety and Insurance Appeals Tribunal (2007) – an appeal representing a school board successfully defending against the multiple chemical sensitivity occupational disease claim by a 30-year chemistry teacher and an appeal representing a large multi-location employer successfully challenging a $200,000 WSIB health and safety penalty assessment.

Professional and Community Affiliations

  • In 2008, David completed 6 years as a director of the Toronto Board of Trade.  During his tenure as a director, he served as the Board's Vice Chair, Secretary and Treasurer.
  • He helped establish, and is a former Chair of the Workplace Safety and Insurance Law Subsection of the Ontario Bar Association ("OBA").
  • David chaired the Law Society of Upper Canada's Workplace Safety and Insurance Law Speciality Committee and helped establish the standards for certification.
